Anticipation Over, Governor Snyder Unveils Budget Recommendations
Governor Rick Snyder was joined by Lt. Governor Brian Calley and Budget Director John Nixon before a joint hearing of the Senate and House Appropriations committees, Senate Finance and House Tax Policy committees Thursday to present his budget recommendations for the 2012 fiscal year and projections for the 2013 fiscal year.
Beginning his presentation by describing the difficulty through which the recommendations were developed and announcing his intention to return all but $1 of his $159,300 salary, Governor Snyder proceeded to outline extensive tax reform proposals and $1.5 billion in cuts. Though the Republican Governor enjoys a Republican majority in both the House of Representatives and the Senate, the coming weeks are sure to be a challenge as the Governor seeks to have the budget process complete by May 31st. Highlights of the budget proposal include:
• Higher education would be cut by 15 percent, with $83 million set aside for distribution to universities that keep tuition increases below 5-year, system-wide averages. Universities will be funded through a formula beginning in fiscal year 2013 based, in part, on graduation rate.
• Statutory revenue sharing of more than $300 million would be eliminated and replaced by $200 million in combined money distributed to those municipalities that adopt best practices to be announced in March.
• A 48-month lifetime limit on able-bodied welfare recipients.
• No cuts, as promised earlier this week, to Medicaid services.
• The closing of one prison facility, privatization of some prison services such as food service and prison stores and Corrections employee concessions.
Highlights of the tax reform proposal include:
• Elimination of the Michigan Business Tax (MBT) and implementation of a 6 percent net corporate income tax on C-corporations only.
• Honoring of those “contractual” credits promised under the MBT (e.g. MEGA, Brownfield, etc.) through a yet-to-be-determined manner (either by allowing the businesses to elect to continue filing and paying the MBT or by applying the credits to the new tax structure).
• Lowering of the individual income tax rate from 4.35 percent to 4.25 percent in October, 2011 as scheduled – but locking the rate at that level.
• “Flattening” of the individual income tax base by elimination of nearly all credits and exemptions, including the Earned Income Tax Credit (EITC), and the exemptions applicable to both private and public pensions.

Emergency Financial Manager Reform Measures Move
The Legislature took a step this week towards delivering on State Treasurer Andy Dillon’s hopes for significant reform to the laws governing emergency financial managers (EFMs) appointed to financially troubled local government units when the House Local, Intergovernmental & Regional Affairs Committee passed House Bills 4214 – 4218 and 4246.
The package removes authority from local officials when an EFM is appointed to a financially stressed municipality or school district and allows the EFM to renegotiate contracts, enter into service consolidation agreements, sell assets, and set minimum staffing levels.
Passing on party-line votes, the measures were changed only twice by Democratic members of the House panel, who offered 27 amendments. A 6-year ban from seeking elected office for officials in a community under an EFM was removed, as well as the requirement that EFMs have 10 years of experience in local or state budget or fiscal matters.
Treasurer Dillon has asked the Legislature to pass the bills to the Governor’s desk by the end of February to ensure the Administration’s ability to deal with an expected significant increase in municipalities and school districts needing an EFM.

Item Pricing Repeal Passes In House
On a nearly party-line vote, the House of Representatives passed House Bill (HB) 4158 Wednesday, repealing the law that requires most retail items to be individually priced. Six Democrats (Representatives Tim Bledsoe (D-Grosse Pointe), Harold Haugh (D-Roseville), Lesia Liss (D-Warren), Tim Melton (D-Auburn Hills), Roy Schmidt (D-Grand Rapids) and Maureen Stapleton (D-Detroit) joined all 63 Republican caucus members in what ended up being a 69-41 final vote tally.
HB 4158, sponsored by Representative Lisa Lyons (R-Alto) still requires retailers to place signs displaying the price near every item sold, but no-longer requires each item to be individually priced. Added to the support of retailers and grocers was the AARP and Attorney General Bill Schuette who’s office will received $100,000 under the measure to educate the public on the changes in statute.
Republicans hold out that the measure sends a positive message about the new manner in which the State Government will treat business. The bill will now move to the State Senate.

Canadian Crossing News
Five large West-Michigan businesses offered their support to efforts to build a new International crossing of the Detroit River into Canada. Amway Corporation, Kellogg Company, Meijer, Inc., Steelcase, Inc., and Wolverine World Wide, Inc. stated the project would build on the state’s existing strengths and provide a positive economic boost.
Meanwhile, House Transportation Committee Chair Representative Paul Opsommer (R-DeWitt) has been meeting with Snyder Administration lobbyist Dick Posthumus and others and indicated that talks will continue as a deal has not-yet been reached.

Hilfinger Named DELEG Director
Governor Rick Snyder announced the appointment of metro-Detroit attorney Steve Hilfinger as Director of the Department of Energy, Labor & Economic Growth succeeding interim Director Andy Levin, former Governor Granholm’s appointment. A 1984 graduate of the University of Michigan and 1987 graduate of Northwestern University School of Law, Hilfinger had a 23-year legal career with expertise in corporate acquisitions, restructuring and regulatory affairs, most recently as the managing partner of Foley & Lardner’s Detroit office.
Hilfinger received the William A. Paton Award for the highest score on the Michigan CPA exam and is admitted to practice law in Michigan and Illinois. He will begin his new role on February 28th.
An announcement from Governor Snyder is expected soon regarding the plans by the Administration to restructure and likely rename the huge Department.

Ergonomics Bill Passes On a 12-3 vote, the House Regulatory Reform Committee passed Senate Bill (SB) 20, legislation preventing a department, commission, or board from promulgating rules requiring companies to enforce ergonomic standards. The House panel addressed the legislation less than a week after receiving the measure from the Senate.
Speaker Announces Campaign Team The full composition of the House Republican Campaign Committee was announced by Speaker Jase Bolger (R-Marshall). In addition to returning Chair Rep. Pete Lund (R-Shelby Township) and Finance Co-Chairs Reps. John Walsh (R-Livonia) and Joe Haveman (R-Holland), the 2011-2012 committee will consist of Reps. Jeff Farrington (R-Utica), Peter MacGregor (R-Rockford), Aric Nesbitt (R-Lawton), Wayne Schmidt (R-Traverse City), Deb Shaughnessy (R-Charlotte), and Jim Stamas (R-Midland).
Brewer Re-Elected Detroit TV producer Ron Scott ended his run for Michigan Democratic Party Chair Saturday morning at the state convention when convention rules required him to pay a $1,000 fee to be on the ballot. Incumbent Chair Mark Brewer was then elected on a unanimous ballot. In other news from the convention, United Auto Workers (UAW) President Bob King was elected to fill a vacancy as a member of the Democratic National Committee.
